IMPORTANT UPDATE

The Ministry of Economy’s Telecommunications and Digital Government Regulatory Authority (TDRA) has introduced Cabinet Resolutions Nos. (56) and (57) of 2024 highlighting the regulations and penalties related to telemarketing practices in the UAE.

These regulations aim to organise telemarketing activities to ensure economic and social stability, uphold marketing norms, and safeguard consumer privacy.

It is critical that you understand these regulations and comply with them to avoid significant penalties and possible suspension of licence, as adherence to the regulations will be monitored. 

KEY HIGHLIGHTS

Applicable to all companies operating within the UAE, including those in free zones, and restrict natural persons from making unsolicited marketing calls.

  • Operational requirements for companies:
    • Obtain authorisation for telemarketing activities.
    • Use locally registered phone numbers.
    • Refrain from contacting numbers listed on the Do Not Connect Register (DNCR).
    • Provide mandatory training on ethical telemarketing practices.
    • Maintain records of all telemarketing calls and submit periodic reports.
    • Inform consumers about the recorded nature of calls and the identity of the company at the start of each call.
  • Calling guidelines:
    • Prohibit undue pressure, deception, or misleading tactics.
    • Restrict marketing calls to the hours between 9:00 AM and 6:00 PM.
    • Limit repeat calls to consumers who have rejected or not responded to previous offers.
  • Data privacy:
    • Companies are prohibited from disclosing or trading personal consumer data without explicit consent.
  • Administrative penalties:
    • For Companies: Penalties include warnings, fines, partial or total suspension of activities, and possible cancellation of licenses for severe or repeated violations.
    • For Natural Persons: Penalties apply for blocking marketing calls in violation of the regulations, escalating with repeated offences.
